These Terms of Use (“Terms”) are an agreement between you and TappStudio (“TappStudio,” “we,” “us,” or “our”) for your use of Kadak: Idle Chai Empire (the “Game”). By downloading or playing the Game you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Game.
You must be at least 13 years old to play. If you are under 18, or under the age of majority where you live, you may play and make purchases only with the permission of a parent or guardian, who agrees to these Terms on your behalf.
Kadak is a free-to-play game for entertainment. It is not a financial product, a trading or investment tool, a gambling product, a lottery, or a game of chance for money or prizes. There are no real-money stakes, no cash prizes and no way to win or withdraw real money.
This section matters, so please read it.
The Game has three in-game currencies:
All of these are virtual items with no real-world monetary value. They are game points, nothing more.
The ₹ symbol and the word “Rupees” are used only as a theme and scoring device, because the Game is set in India. In-game Rupees, and any figure in the Game that is shown with ₹ (such as income, costs, stall prices, earnings while you are away, lakhs and crores), are not real Indian Rupees, not legal tender, not electronic money, not a cryptocurrency or token, and not a claim on any money. They are not “earned,” “collected,” “held,” “owed,” “paid out” or “received” in any real financial sense.
Because of this:
The Game is not affiliated with, endorsed by, or connected to the Reserve Bank of India, any bank, payment system, or government body.
The price of an in-app purchase is shown by Apple or Google in your local currency before you confirm. In-game ₹ prices of stalls and upgrades are unrelated to real prices.
The Game is free to download and play. Optional purchases may include packs of Elaichi, one-time items (such as permanent income boosts), a season pass (Utsav Pass), shards for a named Ustaad, a video-free pass, and a monthly or yearly membership (Chai Club). Each item states exactly what you receive. The Game does not sell random loot boxes or paid chests for chance rewards. Nothing needs to be bought to play or to finish any content.
All purchases are processed by the Apple App Store or Google Play, using the payment method on your store account, and are governed by their terms. Prices are shown in the store’s local currency and include applicable taxes such as GST where required. We do not receive or store your payment details.
Chai Club is an auto-renewing subscription. It renews at the end of each period (monthly or yearly) at the price shown at purchase, unless you cancel at least 24 hours before renewal in your Apple ID or Google Play subscription settings. Deleting the Game does not cancel a subscription. If you cancel, you keep the benefits until the end of the period you paid for.
When you buy Elaichi or other items, you get a limited, personal, non-transferable licence to use them in the Game. They have no cash value, and they are not property you own.
Refunds are handled by Apple or Google under their policies, and we cannot refund purchases ourselves. If a store refunds a purchase, we may remove the items or benefits it gave. Use Restore Purchases in the Bazaar to get back non-consumable items and your membership on a new device. Elaichi you have already spent, and consumables, cannot be restored.
We may change prices, offers and the content of the Game at any time. Price changes to subscriptions apply from your next billing period as required by the store.
You may choose to watch a short video ad to receive a reward (such as a temporary boost). Watching is always optional. Rewards are virtual items under Section 3. Ads are provided by third parties and may stop being available.
Your progress is saved on your device. You can optionally sync it through Google Play Games or Apple Game Center cloud save. We do our best to protect progress, but we cannot guarantee it will never be lost (for example if you uninstall without a cloud save, lose your device, or a store service fails). We have no obligation to restore lost progress or virtual items, except purchases you can restore from the store.
You agree not to:
We may reset, adjust or remove progress, items or leaderboard entries that result from the above, and stop your access to the Game, with notice where practicable.
The Game, including its name, characters, art, music, sounds, text, code and design, belongs to TappStudio or its licensors and is protected by law. We give you a limited, personal, non-exclusive, non-transferable, revocable licence to install and play the Game for your own non-commercial entertainment. All other rights are reserved.
The Game’s characters, places and businesses are fictional. Any similarity to real brands, businesses or people is unintentional. Place names on the Routes map are shown for flavour only; the map is a stylised illustration and is not a political or survey map.
The Game relies on third-party services such as Apple, Google, RevenueCat, PostHog and Google AdMob. Their own terms and privacy policies apply to what they provide, and we are not responsible for their services.
We may update the Game, add or remove features, run time-limited events and seasons, pause or end the Game, or change or end any virtual item, with or without notice. If we shut the Game down, we will try to give reasonable advance notice. You may stop using the Game at any time by uninstalling it.
THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF LOSS OF PROGRESS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPPSTUDIO IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROGRESS, VIRTUAL ITEMS, DATA OR PROFITS, ARISING FROM THE GAME. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE GAME IS LIMITED TO THE AMOUNT YOU PAID US THROUGH IN-APP PURCHASES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.
Nothing in these Terms limits any right you have as a consumer that cannot be limited by law, or liability for fraud, gross negligence or wilful misconduct.
If you downloaded the Game from the Apple App Store: these Terms are between you and TappStudio, not Apple. Apple has no obligation to provide support or maintenance for the Game, and, if the Game fails to meet a warranty, you may notify Apple to refund the purchase price (if any). Apple is not responsible for claims relating to the Game or your use of it, or for intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country under a US government embargo and are not on a US government list of prohibited or restricted parties.
These Terms are governed by the laws of India. The courts located in India have exclusive jurisdiction over disputes, except where mandatory consumer law in your country of residence gives you the right to bring a claim elsewhere. Before starting a formal dispute, please write to us so we can try to resolve it in good faith.
We may update these Terms. We will update the “Last updated” date and, for material changes, tell you in the Game. Continuing to play after a change means you accept it.
These Terms and the Privacy Policy are the entire agreement between you and us about the Game. If a part is found unenforceable, the rest stays in force. Not enforcing a right is not giving it up. You may not transfer your rights under these Terms; we may transfer ours in connection with a sale or merger.
